These Terms of Service (“Terms”) govern your use of agavedigitalstrategies.com (the “Site”) and any services you engage from Agave Digital Strategies, LLC (“Agave,” “we,” “us,” or “our”). By using the Site or engaging our services, you agree to these Terms.
Our Services
Agave provides websites, marketing, and automation services for home service businesses. Specific deliverables, pricing, and timelines for any engagement are set out separately in a proposal, order form, or agreement between you and Agave, which supplements these Terms.
Billing, Cancellation & Refunds
- Ongoing services (website hosting, marketing, and automation subscriptions) are billed monthly and may be canceled at any time. Cancellation takes effect at the end of your current billing cycle; we do not provide partial-month refunds.
- One-time project fees (such as website builds or initial system setup) are non-refundable once work has begun, since they cover time and resources committed to your project.
- To cancel, contact us using the information below. We'll confirm your cancellation and the effective date in writing.
Acceptable Use
You agree not to use the Site or our services for any unlawful purpose, to transmit harmful code, or to attempt to gain unauthorized access to our systems or any systems we manage on your behalf.
Intellectual Property
You retain ownership of your business content, brand assets, and data. Agave retains ownership of our underlying tools, templates, workflows, and methodologies used to deliver our services, except where otherwise agreed in writing.
No Professional Guarantees
We build and manage marketing and automation systems, but we cannot guarantee specific results (such as lead volume, rankings, or revenue), since these depend on factors outside our control.
Limitation of Liability
To the fullest extent permitted by law, Agave is not liable for indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.
Changes to These Terms
We may update these Terms from time to time. Changes take effect when we post the updated Terms on this page.
Governing Law
These Terms are governed by the laws of the State of Arizona.
